NEW SWISS PROPERTY LAW
A new property law will come into force limiting the construction of second homes.
A quota of 20 % of all construction will be imposed, meaning that many of the popular resorts have already used up this allowance. Building permits approved before March 11, 2012 remain valid but the new law revisions will apply to building applications lodged after that date.
Most of our properties have the necessary building applications approved already, several with a foreigner permit in place!
The details of the new law are being discussed continuously, and the information can be conflicting at times. The Swiss fiduciaires are able to inform the situation in their relevant cantons.
"The experts affirm that building permits issued between March 11 and the end of 2012 should be treated based on the existing, old communal and cantonal laws."
In principal, the new law means after this date no more new chalets and apartment buildings, holiday and secondary homes will be constructed (neither for foreign nor Swiss buyers). Inevitably this will mean that

the value of existing properties will increase

more equity for current property owners will be created
-
capital gains will be achieved from short to medium term of investment.

Currently customers can freely buy already built, or buildings for which permissions already have been approved for second homes according to the current law.
ALL properties built before this period would be 100% INVESTMENTS, as they would absolutely increase in value as existing built properties, as this will be the ONLY option for a second home buyer.
There will be a greater need for hotel beds from this date, so this could be of importance to any commercial buyer.
When the regulation will come into force, the sale of second homes will depend on the law enforcement. It is likely that the following transactions will be allowed:

Acquisition or construction of second homes in non-touristic zones. Probability 100 %

Resale of second homes as second homes. Status quo

At the time of an inheritance the property could pass from primary residence to secondary. Probability 70 %

Transfer of a primary home in to a secondary home on the owner’s will. Probability 20 %
